Terms of Service
Corpus legacy
These terms govern the use of Shareft by photographers and their guests. They will be completed and legally validated before commercial launch.
Purpose of the Service
Shareft lets a photographer (the "Sender") automatically deliver event photos to each participant through facial recognition search. Participants find their own photos by uploading a selfie, with no app to install and no account to create.
Roles of the Parties
The Sender is responsible for processing the data of their event's participants: they decide whether to run selfie search, choose the event's visibility, and collect the necessary consents. Shareft acts as a technical processor, handling selfies and photos solely on the Sender's behalf and for the purposes described in these terms and in the privacy policy. These roles will be formalized under a data processing agreement before commercial launch.
Sender Account
The Sender must provide accurate information when creating an account and keep it up to date, including their email address and billing details. They are responsible for keeping their login credentials confidential and for all activity carried out from their account. An account corresponds to one photographer or business and cannot be shared between multiple users without our agreement.
Free for Participants
The participant being photographed never pays and never needs to create an account to find and download their photos. Only the Sender subscribes to a plan.
Subscription and Payment
The Sender chooses a plan (free Discovery, Standard, or Pro). Payments are processed through payment providers (Mobile Money and card). The subscription carries no commitment and can be changed or cancelled at any time; it stays active until the end of the period already paid for.
Acceptable Use
The Sender agrees to upload only photos from events they shot themselves or for which they hold the necessary rights, and to obtain the consent required from photographed individuals under applicable law. They must not use Shareft to distribute unlawful content, infringe a third party's rights, or attempt to bypass the platform's security (bulk data scraping, unauthorized access to another Sender's events, and similar behavior).
Intellectual Property
Photos uploaded by a Sender remain their property; Shareft acquires no rights over them beyond the technical license needed to store, index, and make them available to participants. The Shareft brand, interface, code, and facial recognition technology, on the other hand, belong to Shareft. Using the service grants the Sender only a personal, non-exclusive, non-transferable right to use it.
Service Availability and Liability
Shareft takes reasonable measures to keep the service available but cannot guarantee uninterrupted operation (maintenance, technical incidents, or a third-party provider outage can all cause downtime). The service is provided "as is." To the extent permitted by applicable law, Shareft's liability to a Sender is limited to the amounts actually paid over the preceding twelve months and excludes indirect damages (lost revenue, data loss not caused by Shareft's fault). This limitation does not apply in cases of gross negligence or willful misconduct.
Termination
The Sender can close their account at any time from their dashboard settings or by contacting support. Shareft may suspend or terminate an account for a serious breach of these terms (fraudulent use, failure to respect photographed individuals' rights, persistent non-payment), notifying the Sender beforehand where possible. On termination, the event's photos and data are deleted according to the timelines set out in the privacy policy, unless the law requires longer retention.
Changes to These Terms
Shareft may update these terms to reflect changes to the service or to applicable regulations. Any material change will be notified by email or through a notice in the dashboard at least 30 days before it takes effect. Continued use of the service after that date constitutes acceptance of the new terms.
Governing Law and Disputes
The governing law and competent jurisdiction will be specified here once Shareft's legal structure is finalized. In case of disagreement, the Sender is invited to first contact our support team to seek an amicable resolution before pursuing legal action.
